Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern access to and use of services, websites, and products provided by Beijing Hecaiji Technology Co., Ltd. ("Hecaiji", "we", "our", or "us"). By accessing or using our services, you agree to these Terms.

2. Service Scope

Hecaiji provides technology and operational services focused on mobile applications and mobile games, including but not limited to development, operation management, monetization optimization, platform compliance support, and post-launch maintenance.

3. Business Models

Our services may be delivered under one or more of the following models:

• Project Operation Services: operation and growth management of existing products.
• Project R&D Services: custom software development and engineering delivery.
• Self-Developed Product Operation: operation and monetization of products owned or co-owned by Hecaiji.

Specific deliverables, timelines, and responsibilities are defined in applicable statements of work or commercial agreements.

4. Developer Policy and Compliance Adaptation

Hecaiji integrates developer policy adaptation into product lifecycle and service workflows. This includes:

• Permission and data minimization controls.
• Transparent user-facing disclosures.
• Compliance review before release and major updates.
• Operational policy monitoring and remediation planning for policy changes.

5. Google Play and App Store Adaptation

For products distributed through app marketplaces, services include adaptation to key platform rules and submission requirements, such as:

• Google Play policy adaptation including Data Safety, permission declarations, and billing compliance.
• Apple App Store adaptation including privacy labels, ATT-related requirements, and in-app purchase policy alignment.
• Support for rejection analysis, remediation, and resubmission processes.

6. Monetization Platform Adaptation

Where monetization features are implemented, Hecaiji supports adaptation to major monetization ecosystems and platform rules, including:

• Subscription, in-app purchase, VIP, and premium feature implementation best practices.
• Advertising and mediation integration controls with region and age-based logic where necessary.
• Revenue and conversion optimization within policy constraints.

7. Global Privacy Protocol Adaptation

Hecaiji supports privacy protocol adaptation for global markets, including workflows aligned to GDPR, CCPA/CPRA, and other applicable frameworks. Adaptation includes policy documentation, consent flows, and data handling configuration support.

8. Global Age Management Adaptation

For products accessible by minors, Hecaiji supports age management design and implementation, including age gate logic, parental controls, child-directed experience limitations, and related compliance controls (such as COPPA and equivalent standards).

9. Client Obligations

Clients agree to:

• Provide accurate and timely project information.
• Secure all necessary rights to content, assets, and third-party materials provided to Hecaiji.
• Review and approve deliverables, policies, and submissions in a timely manner.
• Comply with applicable laws, regulations, and platform terms related to their products.

10. Intellectual Property

Unless otherwise agreed in writing:

• Each party retains ownership of its pre-existing intellectual property.
• Ownership of newly developed deliverables is governed by the applicable commercial agreement.
• Hecaiji retains rights to general know-how, methods, tools, and non-client-specific reusable components.

11. Payment and Commercial Terms

Fees, billing schedules, currencies, taxes, and payment methods are set out in contract documents. Overdue amounts may be subject to service suspension and applicable late fees as permitted by law and agreement.

12. Data, Security, and Confidentiality

• Each party will protect confidential information using reasonable safeguards.
• Hecaiji implements technical and organizational measures to protect service data.
• Where applicable, data processing terms and security controls are defined in contract appendices.

13. Disclaimers and Limitation of Liability

Services are provided according to contractual commitments. To the maximum extent permitted by law:

• Hecaiji does not guarantee uninterrupted service availability in all environments.
• Hecaiji is not responsible for third-party platform decisions, outages, or policy enforcement actions beyond our control.
• Indirect, consequential, incidental, or punitive damages are excluded unless prohibited by law.

14. Indemnification

Each party agrees to indemnify the other party from claims arising out of its own breach of these Terms, unlawful conduct, or infringement caused by materials supplied by that party, subject to contractual limitations.

15. Termination

Either party may terminate services under conditions set forth in the applicable contract, including material breach, insolvency, or mutual written agreement. Upon termination, each party shall fulfill post-termination obligations including payment settlement and return or deletion of confidential data where required.

16. Governing Law and Dispute Resolution

These Terms are governed by applicable laws specified in the controlling commercial agreement. Disputes should first be resolved through good-faith negotiation. If unresolved, disputes may be submitted to arbitration or courts as specified by contract.

17. Changes to Terms

We may update these Terms periodically to reflect legal, business, or service changes. Updated Terms become effective upon publication unless otherwise stated.
